Public Health Law for Tribes

Tribal Emergency Health: Federal Authority; Cooperation; Mutual Aid

Purpose

This Web conferencing presentation and discussion was developed in cooperation with the Northwest Portland Area Indian Health Board (NPAIHB) to address a need identified by tribal leaders. NPAIHB solicited specific input regarding questions tribes had about public health law and authority. This presentation was developed in response to this input. The live session, held September 21, 2006, provided a forum for participants to ask questions and seek advice from the experts.

Intended Audience

Tribal members and those who work with tribal organizations, primarily those who are in the NWCPHP partner region, which includes Alaska, Idaho, Montana, Oregon, Washington, and Wyoming.

Presenters

Jay Furtick is an Assistant Regional Counsel in the Seattle office of the U.S. Department of Health and Human Services, Office of the General Counsel. The office handles a wide range of legal issues for client agencies such as the Centers for Medicare and Medicaid Services, the Office of Public Health and Science, the Indian Health Service, the Administration for Children and Families, the Centers for Disease Control and Prevention and the Health Resources and Services Administration. Jay works with the Portland Area Indian Health Service, providing advice related to Indian Self-Determination Act contracts; IHS-operated clinics; and Area office operations. Jay also handles litigation involving employment and contract disputes. Jay contributes to the Department’s efforts to prepare for public health emergencies, focusing on Indian health issues.

Ellen Miyasato works for the U.S. Department of Health and Human Services providing legal services. Her office handles a wide range of legal issues for client agencies such as the Centers for Medicare and Medicaid Services, the Office of Public Health and Science, the Indian Health Service, the Administration for Children and Families, the Centers for Disease Control and Prevention and the Health Resources and Services Administration. Ellen advises or litigates in the areas of Medicare fraud and abuse, Medicaid disallowances, public health, civil rights, Head Start, and medical liability. In the area of public health, she works on mutual aid issues and contributes to the Department’s efforts to prepare for public health emergencies.
